Pocketpair's Surprise Nintendo eShop Launch Amidst Legal Battle

Pocketpair, the developer embroiled in a legal dispute with Nintendo and The Pokémon Company, unexpectedly released its 2019 title, OverDungeon, on the Nintendo eShop. This action-card game, blending tower defense and roguelike elements, marks Pocketpair's first Nintendo Switch release. The launch, announced without prior warning, coincided with a celebratory 50% discount lasting until January 24th.

The release comes amidst ongoing legal proceedings stemming from allegations of patent infringement related to Pocketpair's popular game, Palworld. Nintendo and The Pokémon Company filed suit in September 2024, claiming Palworld's Pal Spheres infringed upon Pokémon's creature-capturing system patents. Despite the controversy, Palworld received a significant update in December, boosting its concurrent Steam player count. The strategic release of OverDungeon on the Nintendo eShop has sparked speculation online regarding its potential connection to the ongoing lawsuit.

The choice to debut OverDungeon on the Nintendo Switch, while Palworld is available on PS5 and Xbox, is intriguing. Some observers suggest it could be a calculated move in response to the legal challenges. This isn't Pocketpair's first time facing comparisons to Nintendo properties; their 2020 RPG, Craftopia, drew comparisons to The Legend of Zelda: Breath of the Wild. Despite the lawsuit, Pocketpair continues to support Craftopia and actively promotes Palworld, recently announcing a collaboration with Terraria.

The legal battle between Pocketpair, Nintendo, and The Pokémon Company remains ongoing, with limited public updates. Patent experts predict a protracted legal process if a settlement isn't reached. Pocketpair has hinted at future plans for Palworld in 2025, including a Mac port and a potential mobile release. The unexpected launch of OverDungeon adds another layer of complexity to this evolving situation.
